We reply to messages within 24 hours on Business Days.

§4. Technical requirements and use of the Store

To use the Store, including browsing the Goods and placing Orders, you need:

  • a device with internet access,
  • an up-to-date web browser with JavaScript and cookies enabled,
  • an active e-mail account.

Browsing the Goods does not require registration. You can place an Order without creating an Account (as a guest) or after logging in to your Account.

Creating an Account is free and voluntary. When you create an Account, you conclude an agreement with the Seller for the provision of an electronic service for an indefinite period. You can terminate it at any time - just write to hello@effy.com.pl and we will delete the Account without undue delay. This does not affect Orders in progress. The Seller may terminate the Account agreement with 14 days’ notice for important reasons, in particular if the Account is used in a manner contrary to the law or these Terms.

When using the Store, you undertake to use it in accordance with the law and good practice, respecting the rights of the Seller and of others. Providing unlawful content and taking actions that could disrupt the operation of the Store is prohibited.

We do our best to keep the Store running without interruption. We nevertheless reserve the right to short technical breaks, which we will announce in advance where possible. Complaints regarding the operation of the Store or the Account can be submitted to hello@effy.com.pl; we will handle them within 14 days.

§5. Placing Orders and concluding the Sales Agreement

Orders can be placed through the website 24 hours a day, 7 days a week. To place an Order:

  1. Choose the Goods and size, then add them to the Cart.
  2. In the Cart, review the selected Goods, their quantity and size. You can change or remove them at any time.
  3. Proceed to checkout and enter the details needed for delivery (and, if you would like an invoice, your invoice details). You can log in to your Account or order as a guest.
  4. Choose the shipping method and the payment method.
  5. Before placing the Order you will see its summary: the Goods, their prices, the shipping cost and the total amount payable.
  6. Accept the Terms, confirm that you have read the Privacy Policy and click the button confirming an Order with an obligation to pay (“Buy and pay”).
  7. Pay for the Order using the selected payment method (with cash on delivery - to the courier when the parcel is delivered).

Until you click the “Buy and pay” button, you can freely change the contents of the Cart and the details provided.

After placing an Order you will receive an automatic confirmation of its receipt at the e-mail address provided, containing the Order number, the list of Goods, prices, the shipping cost and the total amount. The Sales Agreement is concluded once the Seller confirms the Order, i.e. when this confirmation is sent to you.

The content of the Sales Agreement is recorded, secured and made available to you in the confirmation e-mail and - if you have an Account - in your Order history. The version of the Terms in force on the day the Order is placed is available on the Store’s website; we recommend saving it together with the confirmation.

If, in an exceptional situation, we are unable to fulfil the Order (e.g. the Goods in the selected size turn out to be unavailable despite being shown in the Store), we will inform you without undue delay, and in any case within 2 Business Days. You can then change the Order (e.g. choose a different size) or cancel it - we will refund the amount paid without undue delay, and in any case within 14 days.

Want to change or cancel an Order? Write to us as soon as possible at hello@effy.com.pl, quoting your Order number. Until the parcel is dispatched we can usually still make changes. After dispatch you can exercise your right of withdrawal (§9).

§6. Prices

  • Prices in the Store are gross prices in Polish złoty (PLN) and include VAT.
  • Prices of Goods do not include shipping costs. The shipping cost depends on the selected shipping method and is shown in the Cart and in the Order summary - always before the Order is placed.
  • The binding price is the price shown in the Store at the time the Order is placed. Price changes introduced after an Order has been placed do not affect Orders already placed.
  • Whenever the price of Goods is reduced, next to the reduced price we show the lowest price of those Goods that applied during the 30 days before the reduction. If the Goods have been on sale for less than 30 days, we show the lowest price since they went on sale.
  • If we make discount codes or promotions available, the rules for using them (including the validity period and any restrictions) will be given with each promotion. Discount codes cannot be combined unless we expressly state otherwise.

§7. Payments

You can pay for your Order in the Store in one of the following ways. You will see the available methods in the last step of placing the Order, under “Payment options”; the list may depend on your address, the chosen shipping method, the Order amount, your device and your browser:

  • payment card - Visa, Mastercard and, if your device and browser support them, Apple Pay and Google Pay,
  • BLIK,
  • Przelewy24 - instant online transfer from your bank,
  • Klarna - pay now, later (e.g. in 30 days) or in 3 instalments, if Klarna offers you that option (see the rules below),
  • cash on delivery - only with the “InPost Kurier Pobranie” (courier, cash on delivery) shipping method (see the rules below).

Payments are handled by the payment operator Stripe Payments Europe, Limited, with its registered office in Dublin, One Wilton Park, Wilton Place, Dublin 2, D02 FX04, Ireland, company number 513174 (“Stripe”), except for the direct Przelewy24 payment described below, if we make it available, and for cash on delivery. You enter card details in a secure Stripe form on the Order page and the BLIK code in the BLIK field on the Order page (we pass it to Stripe); with Przelewy24 and Klarna you confirm the payment on the operator’s page to which we redirect you. How the payment works:

  • payment card - you enter your card details in the Stripe form and the payment is made when you click “Buy and pay”. If your bank requires it, you will additionally confirm it, e.g. in your banking app (3-D Secure). With Apple Pay or Google Pay, after clicking “Buy and pay” you confirm the payment in the Apple Pay or Google Pay sheet on your device;
  • BLIK - generate a code in your banking app, enter it in the BLIK field, click “Buy and pay” and confirm the payment in your banking app. A BLIK code is valid for a short time only - if it expires, generate a new one;
  • Przelewy24 - after clicking “Buy and pay” you will be redirected to the Przelewy24 service operated by PayPro S.A., with its registered office in Poznań, ul. Pastelowa 8, 60-198 Poznań, entered in the Register of Entrepreneurs of the National Court Register under KRS no. 0000347935, NIP 779-236-98-87, REGON 301345068. There you choose your bank, accept the Przelewy24 terms (in Polish) and confirm the transfer, and then return to the Store;
  • Klarna - after clicking “Buy and pay” you will be redirected to Klarna, where you choose an available option and confirm the payment, and then return to the Store.

Klarna. Klarna payments are provided by Klarna Bank AB (publ), with its registered office in Stockholm, Sveavägen 46, 111 34 Stockholm, Sweden, registration no. 556737-0431 (“Klarna”), under an agreement you conclude directly with Klarna and on its terms (in Polish). The Seller is not a party to that agreement. Klarna decides whether and which options to offer you and may verify your identity and assess your creditworthiness for that purpose. Klarna will present the terms of the selected option, including the payment dates and schedule and the consequences of late payment, before you confirm it. Klarna is available only to adult Consumers - it cannot be used for purchases related to business activity (e.g. with a company invoice).

Once Klarna accepts the payment, we receive the Order price via Stripe, and only Klarna is entitled to receive payment from you. You repay the amount directly to Klarna - do not pay it into the Seller’s account. Matters concerning the Goods, delivery, withdrawal and complaints are handled with us; matters concerning repayment - with Klarna. The refund method (including for Klarna payments) is described in §9 and applies to all refunds.

Saved card. If you have an Account, when paying by card you can tick the box to save your card for future purchases. Saving a card is voluntary and is not a condition for placing an Order. We charge a saved card only when you choose it to pay for an Order you place. You can delete it at any time in “My account → Payment methods”.

Przelewy24 directly. If, in the last step of placing the Order, you see a separate payment method outside the Stripe form labelled “Przelewy24” (e.g. “BLIK - Przelewy24”, “Card - Przelewy24”), payments with that method are handled directly by PayPro S.A. (details above), under the Przelewy24 terms. After clicking “Buy and pay” you will be redirected to the Przelewy24 service, where you complete the payment.

Cash on delivery. This method is available only with the “InPost Kurier Pobranie” shipping method, and it is then the only payment method; with other shipping methods you will not see it. You pay the Order price (including the shipping cost) to the InPost courier when the parcel is delivered - InPost Sp. z o.o. collects the payment on our behalf. The cost of cash-on-delivery shipping is given in §8.

All online payments are encrypted. We never see or store your full card number or CVC - they go only to the payment operator. If you save a card, in connection with it we store only the card identifier issued by Stripe, the card brand, the last four digits and the expiry date.

All payments in the Store are processed in Polish złoty (PLN). If your card or account is held in another currency, your bank will convert the amount at its own exchange rates and fees. We do not charge any additional fees for using the selected payment method (cash-on-delivery shipping has its own price, given in §8).

Online payment is made upfront, when the Order is placed (for Klarna - when Klarna accepts the payment). With cash on delivery you pay when the courier delivers the parcel.

If an online payment is not confirmed within 60 minutes of placing the Order, the Order will be cancelled and any concluded Sales Agreement is terminated (this being a resolutive condition). You can place a new Order at any time.

A proof of purchase (receipt or invoice) is issued for every Order. We issue VAT invoices on request - mention it in the Order notes and provide your invoice details (including your tax ID if you are buying for a business). You agree to receive invoices electronically, at the e-mail address provided in the Order.

§8. Shipping

We ship Goods within Poland and to the European Union countries listed in the table below. Shipping methods and costs within Poland:

  • Courier (InPost Sp. z o.o.) - 1-2 Business Days - 18.99 PLN,
  • Courier, cash on delivery (“InPost Kurier Pobranie”, payment on delivery) - 1-2 Business Days - 20.99 PLN,
  • InPost parcel locker - 1-2 Business Days - 17.99 PLN,
  • Free shipping - for Orders with a Goods value of 699 PLN or more (any shipping method within Poland).

Abroad, we ship by DPD courier (carrier: DPD Polska Sp. z o.o. and, in the destination country, a partner in the DPD network). The shipping cost is fixed for the whole Order and depends on the destination country. Free shipping does not apply to shipments abroad. Costs and the delivery time estimated by the carrier:

* To these countries we deliver only where DPD can reach by road. If the parcel cannot be delivered to the address provided (e.g. to some islands), we will contact you to arrange a different delivery address or a refund of the amounts paid.

Paid Orders placed before 3:00 PM on a Business Day ship the same Business Day. Orders placed later or on non-working days ship the next Business Day. The delivery time (1-2 Business Days within Poland, abroad as shown in the table above) is counted from the day of dispatch, and the day of dispatch itself does not count. In any case we will deliver the Goods no later than 30 days from the conclusion of the Sales Agreement.

Once your parcel ships, you’ll receive an email with a tracking number. If dispatch is delayed, we will let you know.

The risk of accidental loss of or damage to the Goods passes to the Consumer when the Goods are handed over to the Consumer or to a person designated by the Consumer other than the carrier. We recommend checking the condition of the parcel on receipt. If the packaging is damaged, you can draw up a damage report with the courier or report the damage in the InPost app - this makes handling the matter easier, but is not a condition for filing a complaint.

If a parcel is returned to us as uncollected, we will contact you to arrange re-shipment (paid according to the shipping price list) or a refund. If you do not reply within 14 days, we will treat this as cancellation of the Order and refund all amounts paid.

§9. Right of withdrawal

If you are a Consumer or a Sole trader with consumer rights, you have the right to withdraw from the Sales Agreement within 14 days without giving any reason and without incurring costs, except for the costs indicated below (Article 27 of the Consumer Rights Act).

The 14-day period runs from the day on which you, or a person designated by you (other than the carrier), received the Goods. If Goods from one Order are delivered separately, the period runs from receipt of the last of them. It is sufficient to send your statement before the period expires.

To withdraw from the agreement, send us an unequivocal statement - the easiest way is by e-mail to hello@effy.com.pl (you can also send it by post to the Seller’s address). You may use the model form in §10, but this is not obligatory. We will promptly confirm receipt of your statement by e-mail. A practical step-by-step guide is available under Returns & Complaints.

Return the Goods to us without undue delay and no later than 14 days from the day on which you withdrew from the agreement, to: Effy Sp. z o.o., ul. Dąbrowskiego 3/3, 62-300 Września, Poland. The deadline is met if you send the Goods back before it expires. You bear the direct cost of returning the Goods.

You may examine the Goods as you would in a physical shop - try them on and look them over. You are liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning (e.g. wearing, washing, removing tags).

We will refund all payments received from you, including the cost of delivering the Goods to you, without undue delay and no later than 14 days from the day we receive your statement of withdrawal. The refund is made using the same means of payment used for the purchase - for cards (including Apple Pay and Google Pay) back to that card, for BLIK and Przelewy24 to the bank account the payment was made from, and for Klarna via Klarna, which reduces your balance by the refunded amount and, if you have already paid more than the remaining balance, pays back the difference (for a refund of the whole Order it cancels the unpaid part and returns any amounts already paid) - unless you expressly agree to a different refund method. In any event you will not incur any fees as a result. If you paid cash on delivery, the refund will be made by bank transfer to an account you specify (e.g. in the withdrawal form) - by specifying the account you agree to this refund method. If a refund via the same method turns out to be impossible (e.g. the card or account has been closed), we will contact you and - with your consent - refund the money by bank transfer to an account you specify, at no cost to you. The refund method described above (including refunds via Klarna and, with your consent, bank transfer where a refund via the same method is impossible) also applies to all other refunds described in these Terms, in particular in §5, §8 and §11. If you chose a shipping method other than the cheapest standard method offered in the Store for your country, we do not refund the additional costs resulting from that choice. We may withhold the refund until we have received the Goods back or until you have supplied evidence of having sent them back, whichever is earlier.

The right of withdrawal does not apply in the cases listed in Article 38 of the Consumer Rights Act, including where the Goods are non-prefabricated, made to your specifications or clearly personalised, or where the Goods are delivered in sealed packaging and cannot be returned after unsealing for health protection or hygiene reasons. Currently none of the Goods in the Store fall into these categories - if this changes, we will say so on the product page before you place an Order.

§10. Model withdrawal form

Complete and return this form only if you wish to withdraw from the agreement (model consistent with Annex 2 to the Consumer Rights Act). Simply copy the fields below into an e-mail:

  • To: Effy Sp. z o.o., ul. Błażeja Winklera 6H/35, 61-001 Poznań, Poland, e-mail: hello@effy.com.pl
  • I/We(*) hereby give notice that I/we(*) withdraw from my/our(*) contract of sale of the following goods(*): [names and sizes of the Goods]
  • Order number: [number]
  • Date of conclusion of the contract(*)/of receipt(*): [date]
  • Name of consumer(s): [full name]
  • Address of consumer(s): [address]
  • Signature of consumer(s) (only if this form is notified on paper)
  • Date: [date]
  • (*) Delete as appropriate.

§11. Complaints - non-conformity of the Goods with the agreement

The Seller is obliged to deliver Goods that conform to the agreement. Towards Consumers and Sole traders with consumer rights, the Seller is liable for any lack of conformity of the Goods with the agreement under the rules set out in Chapter 5a of the Consumer Rights Act (Articles 43a-43g).

We are liable for a lack of conformity existing at the time of delivery and becoming apparent within 2 years of that time. A lack of conformity that becomes apparent within 2 years of delivery is presumed to have existed at the time of delivery.

Goods conform to the agreement if, in particular, they correspond to the description, type, quantity and quality given in the Store, are fit for the purposes for which goods of that type are normally used, and are of the quality and durability typical of such goods that you can reasonably expect.

You can file a complaint by e-mail to hello@effy.com.pl or in writing to the Seller’s address. Quote your Order number, describe the problem (attach photos if possible) and tell us what you expect. We will respond within 14 days of receiving the complaint. If we do not respond within that time, the complaint is deemed to have been accepted.

Under a complaint you may request repair or replacement of the Goods. We may replace the Goods when you request repair, or repair them when you request replacement, if the remedy you have chosen is impossible or would involve excessive costs. If both repair and replacement are impossible or would involve excessive costs, we may refuse to bring the Goods into conformity. We carry out the repair or replacement within a reasonable time and without significant inconvenience to you, at our expense - including the cost of returning the Goods under complaint. You make the Goods available to us for collection; we will agree the method of collection or return with you by e-mail.

You may make a statement of price reduction or withdrawal from the agreement where: we have refused to repair or replace the Goods; we have not brought the Goods into conformity; the lack of conformity persists even though we have tried to remedy it; the lack of conformity is so serious that it justifies an immediate price reduction or withdrawal; or it is clear from our statement or the circumstances that we will not bring the Goods into conformity within a reasonable time or without significant inconvenience to you. The reduced price shall bear the same proportion to the contractual price as the value of the non-conforming Goods bears to the value of conforming Goods. You may not withdraw from the agreement if the lack of conformity is minor (it is presumed to be significant). Amounts due under a price reduction or withdrawal are refunded without undue delay, no later than 14 days from receipt of your statement (for withdrawal - from receipt of the Goods or of evidence of their return).

The Goods in the Store are not covered by a separate guarantee from the Seller or the manufacturer. This does not limit your rights arising from the non-conformity of the Goods with the agreement.

Towards Customers who are neither Consumers nor Sole traders with consumer rights, the Seller’s liability under the statutory warranty for defects (Article 556 et seq. of the Civil Code) is excluded.

§12. Out-of-court complaint and redress procedures

First, simply write to us - we resolve most matters amicably within a few days. If you are a Consumer and we do not accept your complaint, in our reply we will tell you whether we agree to out-of-court dispute resolution and which body is competent.

A Consumer may use, among others, the following out-of-court complaint and redress procedures:

  • an application for out-of-court resolution of a consumer dispute to the Provincial Inspector of Trade Inspection (the body competent for the Seller: the Provincial Inspectorate of Trade Inspection in Poznań - Wojewódzki Inspektorat Inspekcji Handlowej w Poznaniu) under the Polish Act of 23 September 2016 on out-of-court resolution of consumer disputes,
  • an application to the permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection,
  • free assistance from a district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection (e.g. the Polish Consumer Federation - Federacja Konsumentów),
  • information on out-of-court dispute resolution available on the website of the Polish Office of Competition and Consumer Protection (UOKiK): www.uokik.gov.pl.

Use of out-of-court procedures is voluntary and requires the consent of both parties. Regardless of the above, you may pursue your rights before the ordinary courts competent under the Polish Code of Civil Procedure.

§13. Sole trader with consumer rights

The provisions of these Terms concerning Consumers with regard to the right of withdrawal (§9-§10) and non-conformity of the Goods with the agreement (§11) also apply to a Sole trader with consumer rights (Article 7aa of the Consumer Rights Act). The out-of-court procedures described in §12 are available to Consumers only.

The Seller may verify whether the Sales Agreement is of a professional nature for you, in particular on the basis of the scope of business disclosed in the Polish Central Register and Information on Economic Activity (CEIDG).

§14. Personal data

The Seller is the controller of your personal data. We process data to fulfil Orders, run your Account, handle complaints and returns, meet tax and accounting obligations, reply to your messages and keep the Store secure and, if you consent, to save your card for future purchases. Providing data is voluntary but necessary to place an Order; saving a card is entirely optional.

Detailed information on the purposes and legal bases of processing, recipients of data, retention periods, your rights and cookies can be found in the Privacy Policy.

§15. Final provisions

Agreements concluded via the Store are concluded in Polish and are governed by Polish law. In matters not covered by these Terms, Polish law applies - in particular the Civil Code and the Consumer Rights Act. The choice of Polish law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.

We may amend the Terms for important reasons, in particular in the event of changes in the law, changes to shipping or payment methods, or changes to the Store’s functionality. We will announce any amendment on the Store’s website at least 14 days before it takes effect, and additionally by e-mail to Customers with an Account. A Customer with an Account may terminate the Account agreement during that time. Orders placed before an amendment takes effect are governed by the Terms in force on the day the Order was placed.

The Terms are available in Polish and English. This English version is provided for convenience; in case of discrepancies the Polish version prevails.

Should any provision of the Terms prove invalid or ineffective, the remaining provisions remain in force. No provision of the Terms is intended to limit the rights of Consumers under mandatory law - in the event of a conflict, those provisions take precedence.

The Terms are effective from 1 September 2026. The current wording applies from 22 October 2026 (last updated).
